ECR passport and emigration clearance: who needs it and how it works
Quick answer: If your passport says Emigration Check Required (ECR) and you are going abroad for a job in one of the 18 ECR countries — Saudi Arabia, the UAE, Kuwait, Qatar, Oman and Bahrain among them — you need emigration clearance from the Protector of Emigrants before you fly. A registered recruiting agent or your employer applies for it on eMigrate; if an employer hires you directly, you apply yourself. You also need a PBBY insurance policy. A non-ECR passport needs no clearance.
Is my passport ECR?

The 18 ECR countries
Emigration clearance is needed for a job in Afghanistan, Bahrain, Indonesia, Iraq, Jordan, Kuwait, Lebanon, Libya, Malaysia, Oman, Qatar, Saudi Arabia, South Sudan, Sudan, Syria, Thailand, the United Arab Emirates and Yemen. eMigrate currently shows clearance for Libya and Yemen as suspended.
Without clearance, an ECR passport holder travelling to one of these countries for work may not be allowed through immigration at an Indian airport.
Who can get a non-ECR passport
You are normally eligible for a non-ECR passport if you:
- have passed Class 10 (matriculation) or higher — except in professions the Protector of Emigrants has notified, such as nurses, who need clearance whatever their qualification;
- have worked abroad for more than three years, in one stretch or several;
- are a minor under 18, or over the age of 50;
- pay income tax on established income from a regular profession or business.
To change an ECR passport to non-ECR, apply for a reissue at your Passport Issuing Authority. A new passport is issued — the status is not changed by an endorsement on the old one.
How emigration clearance works
- Through an agent or an employer. If you were hired through a recruiting agent registered with the Ministry of External Affairs, a project exporter, or a foreign employer with a valid permit, they register you on eMigrate and obtain the clearance.
- Hired directly. You apply for emigrant registration yourself on eMigrate's public website. If your employer is registered on eMigrate, it gives you a Job ID, a Job Code and the employment contract it has signed. If it is not, it gives you a demand letter attested by the Indian Mission, the signed contract and a copy of your visa.
- What you upload: your visa, a photograph, a copy of your passport and the employment contract.
- PBBY first. A PBBY policy is a pre-requisite, and eMigrate checks it online with the insurer when you register.
- The Protector of Emigrants for your area processes the application, and the clearance is given electronically.
PBBY insurance
Pravasi Bharatiya Bima Yojana (PBBY) is compulsory for ECR category workers going to ECR countries for employment. It covers ₹10 lakh for death or permanent disability, and the premium is ₹275 for a policy of two years or ₹375 for three, plus taxes. The scheme's details are on the eMigrate portal.
Recruiting agents: what they may charge
- Deal only with a registered agent. Agents are registered with the Protector General of Emigrants — check the agent on eMigrate and ask to see the original Registration Certificate.
- The cap: an agent may charge no more than 45 days' wages, up to ₹20,000. Pay only by demand draft or cheque, and get a receipt.
- The employer pays the rest. Recruitment and travel costs above that — the visa medical, the visa fee, your air fare, the first hotel stay — are the employer's, and the employer may not recover recruitment costs from you during the contract.
- Barred employers: foreign employers on eMigrate's Prior Approval Category (PAC) list may not recruit from India.
- Complaints about overcharging or cheating go on the eMigrate portal.
